ERROR AND ITS ROLE AND SIGNIFICANCE IN CRIMINAL QUALIFICATION

In this article, the concept of error, which is relatively little studied in criminal law, has been studied based on the author’s analytical considerations taking the opinions of various foreign and local jurists into account. The article analyzes the theoretical and practical basis of the error in criminal law, its origin and the division of its study into certain types. The author analyzes the types of legal and factual errors by his opinion, and also cites the basis for dividing the concept of error into other types, and enters into a scientific debate, citing the views of foreign and domestic authors in the field of criminal law. Ideas have been scientifically reasoned with the author’s views on an error and its forms. The analyses were critically studied by the author and legal solutions have been offered. The author also makes suggestions on the criminal classification of the concept of error. Some articles of the Criminal Code were investigated and recommendations for its improvement and elimination of uncertainties are made. The article has a wide range of scientific criminal law considerations, and its conclusions are relevant and will serve to improve criminal law in the future.
