Abstract

 The article examines the issue of recognizing legal entities as subjects of a crime in criminal law. The study analyzes fictitious, realistic, functional, and institutional theories regarding the criminal liability of legal entities. The issue of regulating the criminal liability of legal entities in the legislation of foreign countries was also considered. Based on the principles of classical criminal law, the author addresses the issue of the direct recognition of legal entities as subjects of a crime and justifies the need to develop effective and modern legal mechanisms for combating corporate crime. The article also highlights the advantages and disadvantages of introducing legal liability.
